Hardship Types

  • Extreme Hardship to Qualifying Relatives - For most I-601/I-601A waivers, unless the Beneficiary was convicted of an aggravated felony, in which case the standard is exceptional and extremely unusual hardship.

  • Proof of beneficiary rehabilitation, lack of risk to national security, and favorable exercise of discretion by the USCIS, If barred because of CIMT* involving prostitution or committed 15+ years ago

  • Exceptional Hardship to Qualifying Relatives - For I-612 Waivers

  • Extreme Hardship to Qualifying Relatives and a favorable exercise of discretion - For I-601 waivers involving beneficiary fraud/misrepresentation

  • Favorable Exercise of Discretion (based on 11 factors) - For I-212 waivers.

*CIMT - Crime Involving Moral Turpitude.

Identifying and Detailing Hardships and Qualifying Relatives

Often petitioners and beneficiaries fail to recognize the types of hardships that can support a waiver. Our Customer Service Associates are experienced in guiding clients through the process of identifying potential hardships that they might otherwise miss.

Usually, only U.S. Citizen/LPR spouses, fiance(e)s and parents of the beneficiary are qualifying relatives for purposes of establishing extreme hardship if a waiver is denied. However, when the basis of inadmissibility is a CIMT, or the beneficiary is applying for an I-612 or I-212 waiver, the children of the Beneficiary are also eligible qualifying relatives.

Identifying all the available qualifying relatives is an important part of the Hardship Analysis and the VISS is ever watchful to identify all qualifying relatives.

 

Extreme Hardship can be demonstrated in either the "separation" or "relocation" scenario if the waiver is denied.  When seeking to prove that relocation of a qualifying relative(s) to the beneficiary's home country would inflict extreme hardship on that relative, an understanding of the conditions of the beneficiary's home country is critical to proving hardship.

We can prepare emails and/or correspondence for you to forward to your clients, or we can interact directly with your clients to streamline collection of the necessary evidence of hardship. 

Then, using proprietary software, we assume the time-consuming process of:

  • Cataloging and organizing documents into usable exhibits

  • Converting files to PDF format

  • Splitting or merging client-submitted PDF files into appropriate exhibits

  • Removing unneeded pages from PDF exhibits

  • Tracking receipt of documents and requesting additional documents as needed
